Course Description: Drafting errors and other problems in an ILIT are generally not apparent at inception, but are revealed over time. Even if the ILIT document is satisfactory, there may be various reasons an advisor may wish to modify the ILIT. Because ILITs are irrevocable, it may appear that little can be done. However, it may be possible to modify an ILIT. In this program we will analyze the common law principles and state decanting statutes that permit modification of an ILIT. We will also explore drafting provisions that should be considered in the design of an ILIT to address these problems from inception
Continuing Education Credits: This program is approved for 2 hours of continuing education credit. The course level is basic to intermediate. A certificate will be provided to assist those who complete the course in meeting the reporting requirements.
